Panel 1: THE FULL SOURCE
An anthropomorphic long bolt of fabric labeled RESTATEMENT § 46, COMMENT f enters a courtroom tailor’s shop. Its pattern includes a prominent strip labeled KNOWLEDGE + PROCEEDING.
Source fabric: The context is part of the pattern.
Panel 2: THE ALTERATION
A generic fictional judicial tailor cuts a strip from the fabric using scissors shaped like three dots. The removed strip reads HEARTLESS, FLAGRANT, AND OUTRAGEOUS.
Tailor: Just shortening the quotation.
Panel 3: THE FINISHED FIT
The resulting short fabric is wrapped around a court order labeled SUMMARY JUDGMENT. The removed strip remains visibly on the floor.
Order: Much easier to wear now.
Panel 4: THE LEFTOVER CONTEXT
The anthropomorphic discarded strip looks up at the departing order, holding its own words together.
Discarded context: Funny. I was the part that explained the fit.
Artwork caption: Imagined dialogue. Stevenson Doc. 429; Restatement § 46, comment f.
Behind the cartoon
The Restatement (Second) of Torts is a legal reference discussing civil wrongs, including intentional infliction of emotional distress. Section 46, comment f addresses conduct toward someone known to be particularly susceptible to that distress. In Stevenson v. Stevenson, Judge Kevin M. Miller quoted part of that passage while rejecting plaintiff Marie Stevenson’s emotional-distress claim in his June 16, 2023 summary-judgment order, which dismissed the case without trial. Justice-Denied compares the full passage with the shortened quotation; the omitted text explains how proceeding despite that knowledge can change the character of the conduct.
